1. Information We Collect.
(a) Our Service: We may collect personally identifiable information about you, such as your full name, phone number, email address, or similar, when you register for an account. If you choose to purchase a product from us, we or our third-party payment processors will collect your payment information. We also collect data through our partners (customers) who use the RVFC Service (including by embedding our code on their websites) on their websites or mobile applications. When you use the RVFC Service or if you visit such websites or mobile applications, we may receive certain information about you as described below. We do not send any promotional emails; however, we may send you service related emails related to your account. If you no longer wish to receive these emails, you may opt out of them by cancelling your account.
(b) Cookies And Tracking Technologies: Technologies such as: cookies, beacons, tags and scripts are used by RVFC and our partners (such as advertising, marketing and analytics), affiliates or analytics or service providers. These technologies may be used in analyzing trends, administering the Sites, tracking users’ movements around the Sites and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by such companies on an individual as well as aggregated basis. Our partners may also use such technologies to deliver advertisements to you as described below. We use cookies to remember users’ settings as well as for authentication and analytics. Users can control the use of cookies at the individual browser level. If you reject cookies, you may still use our Sites, but your ability to use some features or areas of our Sites may be limited. This website uses Google Analytics, an analytics tool by Google LLC ("Google"), (1600 Amphitheatre Parkway, Mountain View, CA 94043, United States), to track user activity, page content, click/touch, movement, scroll, and keystroke activity (in some cases). If you are located in Europe, your IP address, keystroke activity, and personal information are never stored or shared with any third-parties. We process and keep all data within Europe and, if you wish to opt-out, you can do so by email us at privacy@rvfc.co.uk.
(c) Log File Information: Log file information is automatically reported by your browser or mobile application each time you access our Sites or the RVFC Service. For example, when you access our Sites or the RVFC Service, our servers automatically record certain information that your web browser sends whenever you visit any website. These server logs may include information such as your operating system, browser type, referring / exit pages and URLs, number of clicks, domain names, landing pages, pages viewed and other such information. We do not link this automatically-collected data to personally identifiable information.
(d) Information Related To Data Collected For Our Customers: RVFC collects information under the direction of its customers, and has no direct relationship with the individuals whose data it may process. If you are a client of one of our current customers and would no longer like to be tracked by such customer, please contact the respective customer directly. We may transfer personal information to companies that help us provide our service.
(e) Access And Retention Of Data Controlled By Our Customers: An individual who is a current or former RVFC customer who seeks access or wishes to correct, amend or delete inaccurate data should direct his query to privacy@rvfc.co.uk. An individual who is a client of a current or former RVFC customer who seeks access or wishes to correct, amend or delete inaccurate data should direct his query to the respective customer first and then, if no response is obtained or such response is not satisfactory, should contact privacy@rvfc.co.uk. If we receive a request under this provision, we will acknowledge it within seventy-two (72) business hours and handle it promptly.
We will retain personal data we process on behalf of our customers for as long as needed to provide our services. RVFC will retain this personal information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements.
2. How We Use Your Information. We use the information that we collect to operate and maintain our Sites and the RVFC Service, send you marketing communications, respond to your questions and concerns and to help our partners improve their online offerings.
3. How We Share Your Information.
(a) Personally Identifiable Information: RVFC will not rent or sell your personally identifiable information to others. We may store personal information in locations outside the direct control of RVFC (for instance, on servers or databases co-located with hosting providers). Any personally identifiable information you elect to make publicly available on our Sites or the RVFC Service, such as listing your contact data on a team page, will be available to others. If you remove information that you have made public on our Sites or the RVFC Service, copies may remain viewable in cached and archived pages of our Sites or the RVFC Service, or if other users have copied or saved that information.
(b) Instances Where We Are Required To Share Your Information: RVFC will disclose your information where required to do so by law, if subject to subpoena or other legal proceeding or if we reasonably believe that such action is necessary to (a) comply with the law and the reasonable requests of law enforcement; (b) to enforce our Terms of Service or to protect the security or integrity of our Service; and/or (c) to exercise or protect the rights, property, or personal safety of RVFC, our users or others.
(c) What Happens In The Event Of A Change Of Control: We may buy or sell/divest/transfer the company (including any shares in the company), or any combination of its products, services, assets and/or businesses. Your information such as customer names and email addresses, and other User information related to the RVFC Service may be among the items sold or otherwise transferred in these types of transactions. We may also sell, assign or otherwise transfer such information in the course of corporate divestitures, mergers, acquisitions, bankruptcies, dissolutions, reorganizations, liquidations, similar transactions or proceedings involving all or a portion of the company. You will be notified via email and/or a prominent notice on our Site of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.
(d) Behavioural Targeting / Re-Targeting: We partner with third parties to manage our advertising on other sites. Our third party partners may use technologies such as cookies to gather information about your activities on this Site and other sites in order to provide you advertising based upon your browsing activities and interests. The only way to completely "opt out" of the collection of any information through cookies or other tracking technology is to actively manage the settings on your browser or mobile device. 4. Storage and Processing. Your information collected through the RVFC Service may be stored and processed in the United States, Europe, or any other country in which RVFC or its subsidiaries, affiliates or service providers maintain facilities. RVFC may transfer information that we collect about you, including personal information, to affiliated entities, or to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that we will not transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction.
5. How We Protect Your Information. RVFC is concerned with protecting your privacy and data, but we cannot ensure or warrant the security of any information you transmit to RVFC or guarantee that your information on the RVFC Service may not be accessed, disclosed, altered or destroyed by breach of any of our industry standard physical, technical or managerial safeguards. When you enter sensitive information (such as log in credentials) on our registration or order forms, we encrypt that information using secure socket layer technology (SSL). No method of transmission over the Internet or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security. If you have any questions about security on our Site, you can contact us at privacy@myclubpro.co.uk. We use an outside help platform, and a direct debit processing company to bill you if you purchase payment products. These companies do not retain, share, store or use personally identifiable information for any other purposes.
6. RVFC self-certifies compliance with EU-US Privacy Shield at the U.S. Department of Commerce. RVFC complies with the EU Data Protection Directive 95/46/EC framework as set forth by the European Union regarding the collection, use, and retention of personal data from European Union member countries and Switzerland. RVFC has certified that it adheres to the requirements of notice, choice, onward transfer, security, data integrity, access and enforcement.
7. Compromise of Personal Information. In the event that personal information is compromised as a breach of security, RVFC will promptly notify our customers in compliance with applicable law.
8. Our Choices About Your Information. For current RVFC customers, you can review, correct, update or delete inaccuracies to the information about you that RVFC keeps on file by logging into your account to update your password and billing information. Alternately (and for former RVFC customers), you can contact us directly at privacy@rvfc.co.uk. We will acknowledge your request within seventy-two (72) hours and handle it promptly. We will retain your information for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements.
9. Children’s Privacy. Protecting the privacy of young children is especially important. For that reason, RVFC does not knowingly collect or solicit personal information from anyone under the age of 13. In the event that we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible. If you believe that we might have any information from a child under 13, please contact us at privacy@rvfc.co.uk. Information entered via the service about a child under the age of 13 must be provided or authorised by their legal parent or guardian (for example when a child under the age of 13 is registered as a player).
10. Notification Procedures. It is our policy to provide notifications, whether such notifications are required by law or are for marketing or other business related purposes, to you via email, written or hard copy notice, or through conspicuous posting of such notice on the Service, as determined by RVFC in its sole discretion. We reserve the right to determine the form and means of providing notifications to you, provided that you may opt out of certain means of notification as described in this Privacy Policy.
11. Links to Other Web Sites. We are not responsible for the practices employed by websites or services linked to or from the RVFC Service or Sites, including the information or content contained therein. Please remember that when you use a link to go from the RVFC Service or Sites to another website or service, our Privacy Policy does not apply to third-party websites or services. Your browsing and interaction on any third-party website or service, including those that have a link or advertisement on our website, are subject to that third party’s own rules and policies.
Social Media Widgets: Our Site includes social media features, such as the Facebook Like button and other widgets, that run on our Site. These features may collect your IP address and which page you are visiting on our Site, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these features are governed by the privacy policy of the organization providing it.

1 GENERAL
1.1 www.rvfc.co.uk is operated by RVFC Ltd ("We" "Us" "Our" "RVFC"). We are registered in England and Wales under company number 15808471 and have Our registered office at 46 Woodrush Close, Rushall, Walsall, WS4 1LX.
1.2 This document (together with the documents referred to in it) tells you the terms of service ("Terms") which apply to Our website www.rvfc.co.uk ("Website"), which provides a website creation service ("Service"). The Terms apply whether you are a guest or a registered user. By using Our Website, you indicate that you accept these Terms and that you agree to abide by them. If you do not agree to these terms of use, please refrain from using the Website. We reserve the right to update and change the Terms from time to time without notice or acceptance by you.
2 BETA TEST WARNING
2.1 The Service is web-based and allows users that register for an account on the Service (each an "Account Holder") to create and update an online sports club website on the Website. Once registered with the Service, each Account Holder receives his or her own website on which to post Content (as defined in clause 8.1). Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including the release of new RVFC tools and resources, shall be subject to these Terms.
3 DESCRIPTION OF SERVICE
3.1 The Service is web-based and allows users that register for an account on the Service (each an "Account Holder") to create and update an online sports club website on the Website. Once registered with the Service, each Account Holder receives his or her own website on which to post Content (as defined in clause 9.1). Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including the release of new RVFC tools and resources, shall be subject to these Terms.
3.2 In order to use the Service, you must arrange for access to the Internet and provide all equipment necessary to make such connection. Our Service may include certain communications from Us, such as service announcements, administrative messages and the RVFC newsletter, which are considered part of RVFC membership, although you will be able to opt out of receiving them. You agree not to access the Service by any means other than through the interfaces that are provided by RVFC for use in accessing the Service.
4 REGISTRATION
4.1 Users under 13 years of age may access the Website but cannot be an Account Holder or create a RVFC ID.
4.2 In order to use the Service, you must have a valid RVFC ID. To be an Account Holder with your own website, you must provide RVFC with a valid email address and other information ("Registration Data"). As an Account Holder, you will choose a password and account designation for your website during the Service's registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account.
4.3 You agree to immediately notify Us in writing of any unauthorised use of your password or account or any other breach of security and you must ensure that you exit from your account at the end of each session. We will not be liable for any loss or damage arising from your failure to comply with this clause 4.3.
4.4 You agree to provide true, accurate, current and complete information about yourself as prompted by the Service's registration form, and you must maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, We have the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any part thereof).
5 CHARGES AND PAYMENT
5.1 Some of our packages are only available if you pay for them. The charges for the different packages are shown on the Website and are inclusive of VAT.
5.2 You can pay for a package online by direct debit. You can also pay by cheque or electronic bank transfer although these methods will incur a £15 administration charge. If you want to pay by bank transfer our bank details are available upon request.
5.3 All payments (except cheques) are processed via 3rd party payment providers and we will not have access to your card and/or bank details at any time.
5.4 The charges will be payable in advance and you can choose whether to pay monthly or annually. If you pay online by credit card or direct debit we will automatically take payment each month/year (as applicable) and will continue to do so until you advise us otherwise.
5.5 Initial subscription term ("Term") is for 12 months from the date of your first payment. You can cancel your subscription at any time after the Term has passed by sending a cancellation request via email to support@rvfc.co.uk, or in writing to our postal address.
5.6 If we accidently take payment after you have given us notice that you no longer wish to pay for a package we will refund you in full. We may also issue you with a refund if any of the package features are not available, but only if the unavailability is due to our act or omission.
5.7 If we are unable to collect payment for any reason or you fail to pay the charges, we may suspend the features of the relevant package until we receive payment in full and in cleared funds.
5.8 You may upgrade or downgrade packages at any time by contacting us directly. If you upgrade to a higher package, the higher package will be available to you as soon as you have paid the relevant charges. If you downgrade to a lower value package, you will be charged the lower amount when your next schedules payment is due. For the avoidance of doubt, you will not be issued a refund if you downgrade part way through a month (if paying monthly) or year (if paying annually).
5.9 We reserve the right to change the charges at any time by giving you not less than 30 days notice.
6 TRANSACTION FEES
6.1 Our Payments system allows you to collect money from your members.
6.2 Each transaction carries a transaction fee to RVFC and also to the relevant payment provider.
6.3 RVFC's standard transaction fee is 1.5%. It is possible to reduce this to 1.0% by subscribing to the Pro Package.
6.4 Current payment provider transaction fees are available via their respective websites. At the time of writing, provider fees for UK clubs are:
GoCardless: 1% +20p (min: 20p, max: £4)
6.5 Because the payment providers offer a financial service only, there is no VAT to pay on their transaction fee.
6.6 Clubs outside of the UK should see provider websites for pricing specific to their location: GoCardless (Direct debit / SEPA), Stripe (Credit & debit cards).
7 CANCELLATION AND TERMINATION
7.1 If you cancel the Service, your cancellation will take effect immediately. After cancellation, you will no longer have access to your website and all information contained therein may be deleted. We accept no liability for such deleted information or content.
7.2 We may, in our sole discretion, terminate your password, and/or account, and remove and discard any Content within the Service (including, but not limited to your website if you are an Account Holder), for any reason, including and without limitation, the lack of use, or if We believe that you have violated or acted inconsistently the Terms. Any contracts, verbal or written, in conjunction with your deleted website, will, at Our discretion, be terminated as well. We may also, in our sole discretion and at any time, discontinue providing the Service, or any part thereof, with or without notice.
7.3 You agree that any termination of your access to the Service under these Terms may be effected without prior notice, and you acknowledge that We may immediately deactivate or delete your website and all related information and files. We reserve the right to bar any further access to such files or the Service. We will not be liable to you or any third-party for any termination of your access to the Service.
8 PRIVACY
8.1 We may collect your data when you use the Website. For further information please see our Privacy Policy and Cookie Notice.
9 OWNERSHIP OF WEBSITE ACCOUNT AND SECURITY
9.1 You are responsible for maintaining the security of your account and website, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the website. You agree to notify Us immediately in writing of any unauthorised use of the account or any other breaches of security. We will not be liable for any loss or damage from your failure to comply with this clause 8. Under no circumstances will We be liable, in any way, for any acts or omissions by an Account Holder or a Guest.
10 CONTENT AND CONDUCT RULES AND OBLIGATIONS
10.1 You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, goods, products, services or other materials ("Content") are the sole responsibility of the person from which such Content originated. You are entirely responsible for all Content that you upload, post, transmit or otherwise make available via the Service. We do not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content.
10.2 You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will We be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, transmitted or otherwise made available via the Service.
10.3 We do not pre-screen Content, but We and Our designees shall have the right (but not the obligation) in Our sole discretion to refuse, move or delete any Content that is available via the Service. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. You acknowledge that you may not rely on any Content created or submitted by Us.
10.4 We may preserve Content and may also disclose Content if required to do so by law or if We believe, in the good faith, that such preservation or disclosure is reasonably necessary to:
10.4.1 comply with legal process;
10.4.2 enforce these Terms;
10.4.3 respond to claims that any Content violates the rights of third-parties; or
10.4.4 protect the rights, property, or personal safety of RVFC, its users and the public.
10.5 You understand that the technical processing and transmission of the Service, including your Content, may involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices.
10.6 Should Content be found or reported to be in violation with, but not limited to, the following terms, it will be in RVFC's sole discretion as to what action should be taken.
10.7 You agree that you will not:
10.7.1 upload, post, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libellous, invasive of another's privacy (including the disclosing of any address, email, phone number, or any other contact information without the written consent of the person to which such information relates), hateful, or racially, ethnically or otherwise objectionable;
10.7.2 impersonate any person or entity, including, but not limited to, a RVFC official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;
10.7.3 forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;
10.7.4 upload, post or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
10.7.5 upload, post or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright, rights of privacy or publicity, or other proprietary rights of any party;
10.7.6 upload, post, or transmit unsolicited commercial email or "spam". This includes unethical marketing, advertising, or any other practice that is in any way connected with "spam", such as (a) sending mass email to recipients who haven't requested email from you or with a fake return address, (b) promoting a site with inappropriate links, titles, descriptions, or (c) promoting your site by posting multiple submissions in public forums that are identical;
10.7.7 upload, post or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; and
10.7.8 interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service.
11 VIRUSES, HACKING AND OTHER OFFENCES
11.1 You must not misuse Our Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to Our Site, the server on which Our Site is stored or any server, computer or database connected to Our Site. You must not attack Our Site via a denial-of-service attack or a distributed denial-of service attack.
11.2 By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and We will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use Our Site will cease immediately.
11.3 We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of Our Site or to your downloading of any material posted on it, or on any website linked to it
12 ADDITIONAL SOFTWARE
12.1 If you elect to download or access any or third party Content or additional software that may be made available by Us in connection with the Service, you understand that you may have to agree to additional terms and conditions before you use such software or third party Content.
12.2 You also agree that the use of any third party software or Content obtained through the Service does not transfer to you any rights, title or interest in or to the software or such Content, and that you will not use any Content made available to you through the software or the Service except as expressly authorised under that third party provider's terms of service or licence. For greater certainty, by downloading software or Content made available through the Service, you are deemed to agree to the terms of service or licence agreement posted on the Service, the terms of which are incorporated by reference herein for the benefit of such third party providers. If you do not agree to the terms of service or licence agreement, do not download the software or Content.
13 INTELLECTUAL PROPERTY RIGHTS
13.1 We are the owner or the licensee of all intellectual property rights in the Service, Website, and in the material published on it and any necessary software used in connection with the Service ("Software"). These works are protected by copyright laws and treaties around the world. All such rights are reserved. Except as expressly authorised by Us or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Software, in whole or in part.
13.2 We do not claim ownership of the Content you place on your website. By submitting Content to RVFC for inclusion on your website, you grant Us a world-wide, royalty-free and non-exclusive licence to reproduce, modify, adapt and publish the Content solely for the purpose of displaying, distributing and promoting your website on any other website under the RVFC brand. This licence shall be terminated at the time your website is terminated.
14 INDEMNITY
14.1 You agree to indemnify Us, and Our subsidiaries, affiliates, officers, directors, agents, co-branders or other partners, from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your Content, your use of the Service, your guests activities, your connection to the Service, your violation of these Terms, whether you are a registered user or not. You are solely responsible for your actions when using the Service, including, but not limited to, costs incurred for Internet access.
14.2 Nothing on this Website constitutes advice, nor does the transmission, downloading or sending of any information or the Material create any contractual relationship.
15 RESALE OF SERVICE
15.1 You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by RVFC.
16 GENERAL PRACTICES REGARDING USE AND STORAGE
16.1 You acknowledge that RVFC may establish general practices and limits concerning use of the Service and may modify such practices and limits from time to time without notice to you.
17 DISCLAIMER
17.1 You expressly understand and agree that our use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
17.2 We will make reasonable efforts to maintain the Service, however, We are not responsible for any damage, loss of data, customer information or vendor data, revenue, or other harm to business arising out of delays, mis-delivery or non-delivery of information, restriction or loss of access, bugs or other errors, unauthorised use due to your sharing of access to the service, or other interaction with the service. You are responsible for maintaining and backing-up your data and information that may reside on the service.
17.3 We do not warrant that:
17.3.1 the Service will meet your specific requirements;
17.3.2 the Service will be uninterrupted, timely, secure, or error-free;
17.3.3 the results that may be obtained from the use of the Service will be accurate or reliable;
17.3.4 the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations; and
17.3.5 any errors in the software will be corrected.
17.4 Any material downloaded or otherwise obtained through the use of the Service is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.
